Judge Vitalii Zahrunnyi is temporarily suspended from administering justice based on the decision of the First Disciplinary chamber of the HCJ

Judge of the Verkhniorohachytskyi district court of Kherson region Zahrunnyi Vitalii Hryhorovych, seconded to the Apostolivskyi district court of Dnipropetrovsk region, is temporarily suspended from administering justice based on the decision of the First Disciplinary chamber of the HCJ.

The decision to bring the judge to disciplinary liability and apply a disciplinary penalty to him in the form of submission for dismissal from the office was made by the First Disciplinary chamber of the HCJ on September 23, 2024.

HCJ dismissed 8 judges

On September 24, 2024, the HCJ decided to dismiss six judges due to the submission of applications for resignation. The list is at the link.

HCJ will make submissions to the President of Ukraine on appointing 15 judges to local courts

On September 24, 2024, the HCJ decided to make submissions to the President of Ukraine on appointing five judges to positions in local courts. The list is at the link.

On September 26, 2024, the HCJ decided to make submissions to the President of Ukraine on appointing ten judges to positions in local courts. The list is at the link.

HCJ changed territorial jurisdiction of cases of the Dobropilskyi city district court of Donetsk region

From October 7, 2024, the HCJ changed the territorial jurisdiction of cases of the Dobropilskyi city district court of Donetsk region by transferring them to the Amur-Nyzhniodniprovskyi district court of Dnipropetrovsk.

Due to the shelling of the Dobropilska territorial community of Donetsk region by the russian federation, as well as in order to preserve the life and health of judges, employees and visitors of the court, there was a necessity to change the territorial jurisdiction of the cases of the Dobropilskyi city district court of Donetsk region.

On September 23, 2024, a roundtable Attractiveness of a judicial career: European and Ukrainian dimensions” was held, organized by the HCJ jointly with the EU Project “Право-Justice”.

The HCJ Chairman Hruhorii Usyk in his welcome speech noted: “The national judicial system operates in critical conditions due to a significant shortage of judges. The situation is particularly difficult in the courts of appeal, where more than 52% of judicial positions are vacant”.

The HCJ Chairman paid attention to the issue that judges work under excessive load conditions, in a situation of constant stress, daily endangered by rocket attacks and artillery shelling. In such conditions, some judges cannot withstand the tension and resign.

During the roundtable, the participants discussed, among other things, the Report of the thematic dialog group of the European network of councils for the judiciary for  2023–2024 on the attractiveness of the judicial career.

Judge of the Khustskyi district court of Zakarpattia region Savytskyi Serhii Anatoliiovych is temporarily suspended from administering justice based on the decision of the Third Disciplinary chamber of the HCJ

The decision to bring judge to disciplinary liability and apply a disciplinary penalty to him in the form of submission for dismissal from the office was made by the Third Disciplinary chamber of the HCJ on September 25, 2024.

Effective administration of justice in war crimes cases was discussed at the roundtable

HCJ member Oksana Kvasha participated in the roundtable “Promoting the fair and effective administration of justice in war crimes cases”, organized by the USAID Program “Justice for All”, which was held on September 27, 2024, for judges, prosecutors, investigators and lawyers.

Oksana Kvasha emphasized that there is an urgent need to introduce the specialization of judges in the consideration of military and war crime offenses. In this context, it is generally necessary to support the draft law No. 10301 “On making amendments to the Law of Ukraine “On the Judiciary and the Status of Judges”, which proposes to introduce in local general and appellate courts the specialization of judges in the consideration of military criminal offenses, criminal offenses against peace, human security and international law and order. HCJ member considers that the introduction of specialization will help unify the consideration of war crimes cases and will allow the formation of a unified court practice.

HCJ canceled the decision of the Disciplinary chamber regarding judge of the Nosivskyi district court of Chernihiv region Volodymyr Korzachenko

On September 26, 2024, the HCJ decided to cancel in full the decision of the First Disciplinary chamber of the HCJ on bringing judge of the Nosivskyi district court of Chernihiv region Korzachenko Volodymyr Mykolaiovych to disciplinary liability and close a disciplinary proceeding.

HCJ temporarily suspended four judges of the Kyiv appellate court from administering justice

On September 30, 2024, the HCJ temporarily suspended from administering justice four judges of the Kyiv appellate court due to bringing them to criminal liability until the court verdict enters into force or the criminal proceedings are closed. The decisions were made based on the results of consideration of the relevant requests of the Deputy Head of the Prosecutor General – Head of the SAPO.
